General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) govern all services, consultations, brokerage activities, projects, events, and collaborations provided by Burget Consulting, Zurich (hereinafter “Burget Consulting” or “Consultant”) for clients, partners, and participants (hereinafter “Client”).
Any differing terms of the Client are only valid if expressly accepted in writing by Burget Consulting.

2. Conclusion of Contract

A contract is concluded upon written acceptance of an offer, the signing of a contract, or by the actual use of a service.
All offers are non-binding and subject to change unless explicitly stated otherwise.

3. Scope of Services

Burget Consulting operates across three strategic business areas:

a) Representation & Business Development

Burget Consulting supports companies, destinations, and hospitality brands in market expansion, sales development, and active lead generation.
Services include market analysis, positioning, representation, strategic partnerships, event participation, KPI-based growth, and reporting.

b) Hospitality Estate Brokerage

Burget Consulting advises owners, operators, and investors in the mediation, valuation, and structuring of hospitality properties and related assets.
Services include property brokerage, transaction coordination, buyer–seller matching, contract facilitation, and confidential access to off-market opportunities.

c) Private Equity & Venture Development

Burget Consulting invests time, expertise, and – where agreed – capital in forward-looking concepts, products, and ventures in the hospitality sector and adjacent markets.
This includes analysis, structuring, development, and strategic guidance up to operational implementation.

Additionally, creative, communicative, and organizational services may be provided, including the conception and execution of Signature Networking Events, leadership programs, and thematic B2B experiences.

4. Client Obligations

The Client undertakes to provide all information, documentation, and access necessary for proper contract performance, completely, accurately, and on time. Delays, additional effort, or costs resulting from incomplete or late information shall be borne by the Client.

5. Prices and Payment Terms

All prices are in Swiss francs (CHF), excluding VAT and expenses.
Invoices are payable within 10 days net.
Burget Consulting may request an advance payment of up to 50% for project-based assignments.
For events, 100% prepayment is required.
In case of late payment, a default interest rate of 5% p.a. applies.
Burget Consulting may suspend ongoing work until payment is received.

6. Cancellation and Withdrawal

By the Client:

  • Cancellations or postponements must be made in writing.
    The following cancellation fees apply, calculated on the agreed total fee:

29 – 14 days 50%
13 – 7 days 75%
6 days or fewer / no-show 100%

 

  • Irrespective of these fees, all binding third-party costs (e.g. hotels, venues, technical or marketing providers) that can no longer be canceled or have already been incurred will be charged 100% to the Client.

By Burget Consulting:
Burget Consulting reserves the right to cancel or postpone services or events for valid reasons (e.g. illness, official restrictions, or force majeure).
Payments already received will be credited or refunded.
Further claims for damages are excluded.

7. Liability

Burget Consulting is liable only for damages caused by intent or gross negligence.
Liability for slight negligence, lost profit, or consequential damages is excluded.
No liability is assumed for third-party services or products merely brokered or referenced by Burget Consulting.

8. Confidentiality

All information obtained during the collaboration will be treated as strictly confidential by Burget Consulting.
This obligation remains in force after the termination of the contract.

9. Copyright and Usage Rights

All concepts, strategies, texts, designs, and materials created by Burget Consulting remain the intellectual property of Burget Consulting.
The Client is granted a simple, non-transferable right of use limited to the purpose defined in the assignment.
Any further use requires prior written consent.

10. Events, Signature Events & Expense Policy

For events, seminars, networking sessions, or fam trips, the following additional terms apply:

  • Participation becomes binding only after payment has been received.

  • Program or location changes may occur.

  • Burget Consulting assumes no liability for personal injury, property damage, loss, or theft of personal belongings during events.

  • Photo, audio, and video recordings may be used for Burget Consulting’s communication and marketing purposes unless the participant explicitly objects in writing.

Event & Expense Policy
Participation fees and expenses are billed transparently based on actual cost.
All travel, accommodation, or additional costs outside the agreed scope are charged separately.

Each service package has a minimum term of three (3) months.
After the minimum term, the agreed contractual termination period applies, but not less than 30 days’ notice to the end of the following month.

  • Premium Clients: One annual event participation is included (cost ceiling CHF 6,000 all-in, valid for contracts longer than six months).

11. Brokerage and Success Fees

If Burget Consulting’s activities result in a business transaction between third parties, the agreed brokerage or success fee becomes due as soon as the contract between those parties is concluded.
The fee remains payable even if the Client ultimately does not make use of the mediated service.

12. Force Majeure

Events such as natural disasters, epidemics, official orders, war, or strikes release Burget Consulting from its performance obligations for the duration of such events.
No claims for damages or withdrawal may be asserted in such cases.

13. Communication

Communication may take place electronically (email, CRM system, video conferencing).
The Client acknowledges that, despite security measures, a residual risk may remain in electronic data transmission.

14. Severability Clause

Should any provision of these GTC be invalid or unenforceable, the remaining provisions shall remain unaffected.
The parties shall replace the invalid clause with an economically equivalent provision.

15. Applicable Law and Jurisdiction

These GTC and all related agreements are governed by Swiss law.
The place of jurisdiction is Zurich, Switzerland, unless mandatory legal provisions specify otherwise.

16. Data Protection

Burget Consulting complies with the provisions of the Swiss Data Protection Act (DSG) and, where applicable, the EU General Data Protection Regulation (GDPR).
Personal data is collected, processed, and stored only as necessary for contract performance, communication, event organization, or for marketing and information purposes.

Burget Consulting takes appropriate technical and organizational measures to protect all data.
Data is only shared with third parties when required for contractual fulfillment (e.g. event, hotel, printing, or IT partners) or when legally required.

Clients and participants have the right to access, correct, delete, or restrict the processing of their personal data.

By using Burget Consulting’s services or participating in events, the Client agrees to this data processing policy.
